Stratford's court challenge to Ontario's strong mayor law will not be heard on Nov. 10 as planned.
In an email reply to Windsor News on Nov. 2, Stratford chief administrative officer André Morin said the Nov. 10 court date "has been moved" and a new date "has not been yet confirmed."
Morin said Stratford's new mayor and council take office Nov. 16, and staff intend to seek their guidance on the case "as soon as possible." He said the city's legal costs "will be made public when we seek further direction later this month," and that the city expects "further clarity on this matter after November 23rd."
The City of Stratford announced the legal challenge on May 11, 2026, following direction from council. In its release, the city said the application argues the strong mayor legislation is inconsistent with section 3 of the Charter of Rights and Freedoms and with the unwritten constitutional principles of the rule of law and democracy, "resulting in the removal of effective representation on City Council."
Why it matters in Windsor
Windsor is one of 26 municipalities whose mayors received strong mayor powers on July 1, 2023, according to the Province of Ontario. Those powers include proposing the municipal budget, appointing the chief administrative officer, hiring certain department heads, and vetoing certain bylaws tied to provincial priorities. Council can override a veto with a two-thirds vote.
Stratford's case challenges the legislation itself, so its outcome could matter to every municipality where the powers apply, including Windsor. Whether the case goes ahead now rests with Stratford's incoming council.
Windsor News will report the new court date and the legal costs when they are released.
